Under Florida Statute 520.23, sellers of residential solar financing and lease agreements must provide buyers a separately acknowledged disclosure statement, in type at least 12 points in size, covering the total cost of the system, whether it is being purchased or leased, financing and payment terms, applicable tax incentives, and the assumptions behind any projected energy savings -- including a required notice that future utility rates are estimates only. Separately, a nationwide 2024 report from the Consumer Financial Protection Bureau found that dealer fees -- typically 10% to 30% of a system's cash price, and sometimes more -- are routinely added to a homeowner's loan principal industry-wide, and are frequently left out of a loan's stated APR. Florida homeowners are not exempt from that pattern, and Florida's own Deceptive and Unfair Trade Practices Act (FDUTPA) provides an additional avenue for homeowners whose contracts involved misrepresentation.
